Terms of Service

1. Acceptance of Terms

By accessing and using AttendFirst, you accept and agree to be bound by these terms. If you do not agree, do not use the service.

2. Description of Service

AttendFirst is a cloud-based attendance management software that provides employee attendance tracking, leave management, and related features for businesses.

3. User Accounts

  • You must provide accurate and complete registration information
  • You are responsible for maintaining the confidentiality of your account
  • You must notify us immediately of any unauthorized use
  • You must be at least 18 years old to create an account

4. Subscription and Payment

  • Free forever plan: up to 5 employees, all features, no time limit
  • Small team plan: ₹2,500/year flat for teams of 6-10 employees, all features
  • Growth plan: ₹499 per employee per year from the 11th employee onward
  • Payment is due at the start of each billing period
  • All fees are non-refundable (see Refund Policy)
  • We reserve the right to modify pricing with 30 days notice
  • Subscriptions automatically renew unless cancelled 7 days before renewal

5. Acceptable Use

You agree not to:

  • Use the service for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the service
  • Interfere with or disrupt the service
  • Upload or transmit viruses or malicious code
  • Collect or store personal data about other users without consent

6. Intellectual Property

The AttendFirst service, including all content, features, and functionality, is owned by AttendFirst and is protected by copyright, trademark, and other intellectual property laws.

7. Limitation of Liability

AttendFirst shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the service.

8. Disclaimer of Warranties

The service is provided "as is" without warranty of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

9. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the service will immediately cease.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Disputes shall be subject to the exclusive jurisdiction of courts in Hyderabad, India.

Privacy Policy

1. Information We Collect

Account information:

  • Name, email address, phone number
  • Company name and business details

Employee data (provided by your company admin):

  • Employee names and email addresses
  • Department and reporting relationships

Attendance data (collected during check-in):

  • GPS location coordinates at time of check-in/check-out
  • Selfie photographs for identity verification
  • Timestamps of all check-in/check-out events
  • Leave requests, approvals, and balances

2. How We Use Your Information

  • To provide attendance tracking and leave management services
  • To generate reports and analytics for your company admin
  • To send notifications (check-in alerts, leave approvals, daily summaries)
  • To communicate with you about your account and service updates
  • To improve our services and fix bugs
  • To comply with legal obligations

3. Data Storage and Security

Your data is stored on secure servers in India. We implement:

  • 256-bit SSL encryption for all data transmission
  • Encrypted storage for selfie photographs
  • Regular security audits and updates
  • Access controls and authentication measures
  • Regular automated data backups

4. Data Sharing

We do not sell your data. We may share information with:

  • Cloud infrastructure providers (for hosting and storage)
  • Payment processors (for subscription payments)
  • Legal authorities when required by law

5. Your Rights

You have the right to:

  • Access - request a copy of your personal data
  • Rectify - correct inaccurate data
  • Delete - request deletion of your data and account
  • Export - download your data in Excel format
  • Object - object to certain types of processing

To exercise these rights, contact us. We respond within 30 days.

6. Data Retention

We retain your data for as long as your account is active. After account deletion, we delete all personal data within 30 days. Anonymized, aggregated data may be retained for analytics. Selfie photographs are stored for 30 days from the date of check-in.

7. Children's Privacy

Our service is not intended for individuals under 18. We do not knowingly collect personal information from children.

8. Changes to This Policy

We may update this policy from time to time. We will notify you by posting the updated policy on this page and updating the "last updated" date. Continued use of the service after changes constitutes acceptance.

Refund Policy

All payments are final and non-refundable.

We offer a free forever plan (up to 5 employees, all features, no time limit) so you can thoroughly evaluate the product before paying. We strongly recommend testing with your team before upgrading.

1. What Is Not Refundable

  • Change of mind after upgrading
  • Non-usage or partial usage of the service
  • Unused employee licenses
  • Business closure or staff reduction
  • Switching to a competitor
  • Any other reason

2. License Count Is Fixed

Once you purchase licenses for the year, the count is fixed for the entire 12-month billing period. You can add more employees at the pro-rated rate, but you cannot reduce licenses mid-term. To adjust for the next billing cycle, contact support at least 7 days before renewal.

3. Cancellation

  • Cancel at least 7 days before renewal to avoid auto-renewal
  • You retain access until the end of your current billing period
  • No pro-rata refunds for early cancellation

4. Support, Not Refunds

If you encounter issues, contact our support team. We will help resolve technical problems, provide training, and fix bugs. However, support does not include refunds under any circumstances.
